Article 1: The Company Blizzard Entertainment Europe S.A.S, which head office is located in Velizy Villacoublay (78143), 32, avenue de l’Europe and operating under the commercial name of Blizzard is organizing a competition on the following website: eu.blizzard.com, from the 1st of October 2010 to the 25th of October (included).
Article 2: The competition is opened to anyone aged 15 or more residing in France, in Belgium, in the United Kingdom or in Luxemburg, or anyone of the full legal age residing in Germany, Austria, Sweden, Finland, Norway, Spain, Italy, Switzerland, Poland, Hungary, Serbia, Croatia, Bulgaria, Czech Republic, Belarus, Ukraine, Russia or in Ireland, except Blizzard's personnel and their family, affiliates or business partners.
Article 3: Entrants automatically accept the terms of this competition and acknowledge the fact that this game being French, the competition is governed by French law.
Article 4: Failure to observe the terms stated here will lead to the nullification of the participation.
Article 5: Only five (5) entries per household will be accepted (same name, same address).
Article 6: Entrants have to connect to the website and sign-in.
Article 7: Entries to the competition will have to be validated and sent online by each entrant before the 25th of October 2010, midnight. The cost of the telephone communication necessary to the entry will be refunded on written request sent to: Blizzard Europe, 32, avenue de l'Europe, Bât Energy 1, 78457 Vélizy-Villacoublay Cedex. The request should legibly bear mention of the competition, the first name, last name and details of the entrant asking for a refund. Communication will be paid back up to €0.50.
Article 8: Aim of the competition.
Entrants have to take an original photography (the Entry Materials) representing a “Diorama” - a hand-made artwork of full-size replica or scale model of a landscape typically showing historical events, nature scenes or cityscapes.
The photographs need to be submitted via our Contest Submission page, in accordance with the contest theme: StarCraft II Dioramas.
The photographs must be submitted in .JPEG or .JPG format and cannot exceed 2 MB in size per file. Entrants warrant and represent that (a) the Entrant has all of the rights necessary to legally submit the Entry Materials to Blizzard for the competition; and (b) all such Entry Materials are original works of authorship on the part of Entrants and have not been copied, in whole or in part, from any other work and do not violate, misappropriate or infringe any copyright, trademark or other proprietary right of any other person or entity.
The photographs should not be modified with any tools or programs. Modified photographs are not accepted.
Blizzard shall decide the winners on grounds of creativity, originality, and accuracy to comply with the contest theme. The decision of Blizzard is final.
Article 9: The winners will be awarded the following prizes:
5 (five) winners will receive a voucher from Alienware valued at $3000 USD for use in their store.
Article 10: The winners will be warned within 10 working days. The prizes will be sent to winners via parcel service to the address they give in the form. OR The winners will be informed individually by e-mail and will be required to give a valid mail address in order to receive their prize.
Article 11: Resale of the prize is forbidden. No exchange of the prize worth against money, another prize, object or service different from a prize eventually won by an entrant will be accepted.
Article 12: The details of each entrant (name and e-mail address) will be transmitted by the Blizzard Entertainment SAS server, which will process the data. The data will be collected during the online subscription of each user on the eu.blizzard.com website according to the « Informatique et Libertés » law, of the 6th of January 1978 and its later amendments, and according to the European directive number 95/46/CE.
Each entrant grants Blizzard Entertainment SAS permission to use the information he is providing within the framework set by the« Informatique et Libertés » law of the 6th of January 1978. Each entrant benefits from the right to access and modify his personal data.
Article 13: In case of litigation, only tribunals in the country of physical residence of the head office of the organizing company will have jurisdiction.
Article 14: Responsibility
In case of circumstances outside Blizzard's control, in a fortuitous case, or under exceptional circumstances (fire, flood, natural disaster, malevolent intrusion in the IT system, strike, jeopardize of the financial and technical viability of the competition etc.), even in the case of its own responsibility (subject to its good faith), Blizzard retains the right to cancel the whole or part of the competition. The present competition will be cancelled in case circumstances outside Blizzard's control, without the entrants or winners being able to claim any form of compensation. Blizzard retains the right to exclude entry to the present competition any individual having cheated, deceived, faked or disturbed the operations stated in this terms. Blizzard retains the right to sue any individual having cheated, deceived, faked or disturbed the operations stated in this terms, or tried to do so. A winner having disturbed the competition in any of the ways described in the present terms will be rightfully denied the right to claim any prize. Any addition or amendment to these terms will be announced on the Internet. They will be considered appendices to the present terms.
To the extent allowable by law, federal, state, and local taxes, including, without limitation, as applicable, VAT taxes and customs which are associated with the receipt or use of any prizes are the sole responsibility of the winner.
Article 15: Grant of license
By submitting your contest Entry Materials, you hereby grant to Blizzard, a non-exclusive, worldwide, royalty free license for the duration of the protection usually granted to authors by laws and convention on copyright to: display and reproduce the Entry Materials which you are submitting to Blizzard in association with Blizzard's contest on its websites ("Licensed Materials"), including, but not limited to eu.blizzard.com and eu.battle.net, for commercial, business, and trade purposes, as well as for advertising and/or publicity purposes. Additionally, you hereby agree and acknowledge that Blizzard may, in its sole discretion, display the Licensed Material, in whole or in part, distorted in character or form, on the Website.
